In the following you can find information about rules for tobacco surrogates marketed in Denmark.

What is a tobacco surrogate

A tobacco surrogate is a product containing nicotine that is not a tobacco product or an electronic cigarette:

  • The product contains nicotine
  • The product does not contain tobacco
  • The product is not a e-cigarette product
  • The product is not an approved drug product

Submit information to the Danish Safety Technology Authority

Manufacturers and importers of tobacco surrogates marketed in Denmark must report the following information to the Danish Safety Technology Authority.. The report must be made digitally via Virk.dk.

The following must be reported:

  • Master data on submitter
  • Trade name
  • Product type
  • All ingredients (ingredient name and quantity and CAS-No if available)

 

All submitters and their products will receive an ID number after reporting.

If composition of a product is changed, a new report have to be submitted. This report must also be made digitally via Virk.dk.

List of registered tobacco surrogates

Tobacco surrogates that are reported will be presented in the register for tobacco surrogates on Sik.dk with the following information:

  • Trade name
  • Product type
  • Submitter name

Labeling and health warnings on tobacco surrogates

The Danish Health Authority is responsible for the rules on labeling and health warnings on tobacco surrogates. Therefore, it is also the Danish Health Authority that can answer you if you have questions about labeling requirements and health warnings.

Naming and packaging requirements for tobacco surrogates

The Executive Order on labeling and health warnings on tobacco surrogates stipulates that tobacco surrogates or packaging must not be able to mislead consumers through naming, use of images or words in general.

The labelling of unit packets and any outside packaging and the tobacco surrogate itself shall not include any element or feature that:

  • Promotes a tobacco surrogate or encourages its consumption by creating an erroneous impression about its characteristics, health effects, risks or emissions
  • Suggests that a particular tobacco surrogate is less harmful than others
  • Suggests that a particular tobacco surrogate has vitalising, energetic, healing, rejuvenating, natural, organic properties or has other health or lifestyle benefits
  • Resembles a food or a cosmetic product
  • Suggests that a certain tobacco surrogate has improved biodegradability or other environmental advantages

The elements and features prohibited in the above include, but are not limited to, text, symbols, names, trademarks, figures or other characters.
