Registration of manufacturing, marketing etc of e-cigarettes

Anyone who manufactures, stores or markets electronic cigarettes or refill containers with and without nicotine must register themselves and places with the Danish Safety Technology Authority prior to marketing

1. Sell only legal products

As a retailer of electronic cigarettes and refill containers with and without nicotine you must ensure that all products comply with the existing regulations.

This involves that the products have been registered with the Danish Safety Technology Authority and comply with a range of requirements on marking, safety and ingredients. If the products have not been registered with the Danish Safety Technology Authority they are illegal to sell.

2. Register cross-border distance selling

If you want to sell electronic cigarettes and refill containers with nicotine cross-border, you must be registered with the Danish Safety Technology Authority. You may not begin selling before the Danish Safety Technology Authority has confirmed that the registration has taken place. 

3. Control the age limit

You must not sell electronic cigarettes and refill containers with or without nicotine to persons under the age of 18. It applies both by selling in Denmark and cross-border distance selling.

If you are not sure of the age of the customer, you must check photo ID card (e.g. passport or driving license). By distance selling you are obliged to prepare an age control system.

4. Advertisement for electronic cigarettes and refill containers is illegal

It is illegal to advertise electronic cigarettes and refill containers with or without nicotine to the general public. Further requirements for advertisement are laid down in. Executive Order No. 65 of 15 January 2021 on prohibition of advertisement, visible placement and display etc. of electronic cigarettes and refillable containers with and without nicotine.
